Welcome to ActBook ("Service"), operated by ActBook App ("Company", "we", "us", "our"). By accessing or using our Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

1. Accounts

When you create an account, you must provide accurate and complete information. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must notify us immediately of any unauthorized access.

2. Subscriptions & Billing

• Free Trial: New accounts may receive a free trial period. At the end of the trial, you must subscribe to a paid plan to continue using the Service.
• Paid Plans: Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law.
• Plan Changes: You may upgrade or downgrade your plan at any time. Changes take effect at the next billing cycle unless otherwise stated.
• Cancellation: You may cancel your subscription at any time. Access continues until the end of the current billing period.
• Price Changes: We may change pricing with 30 days' notice. Continued use after the change constitutes acceptance.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or its infrastructure
• Upload malicious code, viruses, or harmful data
• Resell, redistribute, or sublicense the Service without our written consent
• Use the Service to store or transmit content that infringes third-party rights

4. Your Data

You retain ownership of all data you upload to the Service ("Your Data"). You grant us a limited license to use Your Data solely to provide and improve the Service. We will not sell, share, or use Your Data for purposes unrelated to the Service.

5. Data Isolation

Each subscriber account is logically isolated. Your Data is accessible only to authorized users within your account. We implement technical measures to prevent cross-tenant data access.

6. Service Availability

We strive for high availability but do not guarantee uninterrupted access. We may perform maintenance with reasonable notice. We are not liable for downtime caused by factors beyond our control.

7. Intellectual Property

The Service, including its design, features, and code, is owned by the Company and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding.

8. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

10. Termination

We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. We will make your data available for export for 30 days following termination, after which it may be permanently deleted.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of competent jurisdiction.
